You have a CE Mark. Your device is compliant under the EU Medical Device Regulation, it is on the market in Europe, and clinicians are using it. The natural next question for a growing manufacturer is: when do we enter the United States?

It is a good instinct. The US is the largest medical device market in the world. But here is the mistake many European companies make: they assume a CE Mark is a head start on FDA clearance, that most of the work is already done and the US route is a formality. It is not. The two systems share vocabulary and some underlying principles, but they are separate regulatory regimes with different classification logic, different evidence expectations, and different quality-system obligations. A CE Mark does not shorten the FDA process. What it does give you is a mature technical file, existing test data, and clinical experience you can build on, if you know how to translate it.

First, understand what a CE Mark does and does not carry over

Under EU MDR, your Notified Body assessed your device against the European regulations and issued a CE certificate. The FDA does not recognize that certificate, and it does not accept a Notified Body's conformity assessment in place of its own review. FDA classification is determined by the agency's own product-code framework, not by your EU risk class. A device that is Class IIa or IIb in Europe will adhere to a different classification scheme, follow a different submission pathway, or may require data you were never asked to generate for your CE Mark.

The practical takeaway: treat your CE Mark as a strong foundation of evidence and documentation, not as a credential the FDA will honor. The value is in the underlying data, such as design verification, biocompatibility, and clinical evaluation, much of which can be repurposed if it maps to FDA expectations. 

Step 1: Classify your device the FDA way and determine the appropriate pathway

Everything downstream depends on this step. FDA regulates devices by risk class (I, II, or III) tied to a specific product code and regulation number. Your classification dictates your route to market:

  • General Controls – for inherently low risk Class I devices that do not present an unreasonable risk of illness or injury.
  • 510(k) — the most common pathway for most Class II devices, based on demonstrating "substantial equivalence" to a legally marketed US device (a predicate).
  • De Novo — for low-to-moderate-risk devices that are novel enough to have no suitable predicate device.
  • PMA (Premarket Approval) — the most rigorous pathway, reserved for high-risk Class III devices.

Identifying the right classification and product code early prevents the most expensive kind of mistake: building a submission for the wrong pathway.

Step 2: Find a US predicate and build your substantial-equivalence case

For most European manufacturers pursuing a 510(k), this is the heart of the work. Being marketed in Europe does not establish a predicate; you need a device already cleared in the US that is substantially equivalent to yours with respect to intended/indications for use and technological characteristics. Finding a suitable predicate is where submissions are won or lost. Where your device is genuinely novel and no clean predicate exists, the De Novo route may be the more appropriate path, and it is better to recognize that before you have invested in a 510(k) that FDA will not accept.

Step 3: Reconcile your quality system with the FDA's QMSR

If you hold a CE Mark, you almost certainly operate an ISO 13485–certified quality management system. That is an advantage. As of 2026, the FDA's Quality Management System Regulation (QMSR) incorporates ISO 13485 by reference, replacing the older Quality System Regulation and narrowing the historical gap between the two frameworks.

"Aligned," however, does not mean "identical." The QMSR layers FDA-specific requirements on top of ISO 13485, around labeling, unique device identification, complaint handling, and recordkeeping, and your existing procedures will need a gap analysis to confirm they satisfy the US requirements. Closing those gaps before an FDA inspection is far cheaper than discovering them during one.

Step 4: Appoint a US Agent and register with the FDA

A manufacturer without a physical presence in the United States must designate a US Agent to act as the FDA's point of contact. You will also need to complete establishment registration and device listing (completed after clearance). These are administrative steps rather than technical ones, but they are mandatory, they carry annual obligations, and a US market entry cannot proceed without them.

Step 5: Close the data gaps and prepare the submission

This is where your CE Mark documentation earns its keep, and where its limits show. Much of your technical file will transfer but expect gaps: FDA may expect testing to specific FDA-recognized consensus standards, biocompatibility data structured to its expectations, clinical evidence framed differently than your EU clinical evaluation, and/or human factors evaluation per FDA’s guidance and recognized standard.

Two tools are especially valuable for a first-time US applicant:

  • The Pre-Submission (Q-Sub) program, which lets you ask the FDA specific questions and get written feedback before you submit; an efficient way to de-risk your strategy and confirm your predicate and testing plan.
  • The eSTAR template, the FDA's guided electronic submission format, now required for 510(k)s, which structures your application and reduces the risk of an administrative rejection.

Step 6: Prepare for a possible inspection of your facility

Since your manufacturing site is outside the US, plan for the possibility of an FDA inspection of a foreign facility. The dynamics differ from a Notified Body audit: different investigator expectations, different documentation emphasis, and the logistics of hosting an inspection across time zones and languages. Readiness is a matter of preparation, not luck.

Beyond clearance: actually reaching the US market

Clearance is permission to sell, not a commercial presence. A European manufacturer entering the US still has to solve warehousing, distribution, and often a manufacturer-of-record arrangement. Many companies underestimate this and treat it as an afterthought, only to stall after clearance because they have no US logistics in place.
